3. Legal Basis for Using Cookies

3.1 GDPR and ePrivacy Directive

Under EU law, storing or accessing information on a user's device requires:

3.2 German TTDSG (Telecommunications Telemedia Data Protection Act)

Section 25 TTDSG (effective December 1, 2021, updated as TDDDG May 2024) governs storage of and access to information on terminal equipment:

§25(1) - Consent Requirement: Storing information or accessing stored information on an end user's terminal equipment requires prior consent, except as provided in §25(2).

§25(2) - Exception for Strictly Necessary: Consent is not required when:

  • Solely for carrying out transmission of a communication over an electronic communications network, OR
  • Strictly necessary to provide a telemedia service explicitly requested by the user

Consent Requirements:

  • Must be freely given, specific, informed, and unambiguous
  • Must be obtained before cookies are set
  • "Reject All" must be equally prominent as "Accept All" (Cologne OLG ruling, January 24, 2024)
  • Continued browsing does NOT constitute consent
  • Pre-ticked boxes are prohibited
  • Cookie walls (blocking access unless consent given) are highly problematic

Penalties: Violations can result in fines up to €300,000 under TTDSG, plus potential GDPR penalties if personal data is involved.

3.3 Austrian TKG 2021 (Telecommunications Act)

Section 165(3) TKG 2021 requires informed consent for storing or accessing information on terminal equipment, with exceptions similar to the ePrivacy Directive for technically necessary cookies.

3.4 Swiss FADP and Cookie Consent

Switzerland does not have specific cookie legislation equivalent to TTDSG. Cookie use is governed by:

  • General FADP provisions on data processing
  • Principle of consent for non-essential data collection
  • Transparency requirements

Swiss Approach:

  • Opt-out may be sufficient for lower-risk cookies

17.3 Cookie Blocking Mechanism

Technical Implementation:

  1. Cookie consent banner loads immediately
  2. Non-essential cookie scripts are wrapped in conditional logic
  3. Scripts execute ONLY if consent is granted
  4. Third-party scripts are blocked until consent
  5. Consent decision is checked on every page load

No Pre-Loading: Non-consented cookies and scripts are never loaded, not even temporarily.
